Both Guildford Borough Council (GBC) and Effingham Parish Council (EPC) have been advised by their respective barristers that there is no realistic prospect of a successful judicial review into the recent decision by the Secretary of State into the Berkley Homes and Howard Trust planning appeal.
EPC at their parish meeting last night, agreed to accept the legal advice and to, “scrutinize all future Berkley Homes/Howard of Effingham planning applications, and monitor the actions of the developer and the school to ensure that the development accords with the planning approvals and planning conditions laid down by the Secretary of State”
