Given the recent Secretary of States decision on the Berkley Homes / Howard Trust appeal. This means that the developer must pay a contribution of £2,645,000 towards the “KGV Works”, as their Section 106 agreement. A section 106 agreement is an agreement between a developer and a local planning authority about measures that the developer must take to reduce their impact on the community. A section 106 agreement is designed to make a development possible that would otherwise not be possible, by obtaining concessions and contributions from the developer.
The developer has the option of either paying the contribution to Guildford Borough Council (GBC), or submitting a planning application itself. The agreement states that if the developer submits a planning application, then it must be based on the feasibility proposal (as set out in the agreement), or if modified as agreed between GBC and Effingham Parish Council.
The feasibility proposal for upgrading the KGV Hall is only a partial upgrade of the Hall on the sports side. The proposal was presented at the EVRT AGM, but has not be consulted on widely. Given that Section 106 money is meant to benefit the community, hopefully users of the KGV facilities and Effingham residents will be able to have some say in how the money is spent on upgrading the KGV Hall.
